McKinney-Vento District Plan

The McKinney-Vento Homeless Assistance Act ensures educational rights and protections for children and youth experiencing homelessness. It is the intent of Kiefer Public School District to provide all eligible students under this provision the equal opportunity to access educational services. Strict confidentiality procedures are followed and include a restricted access designation in the Student Information System. The indicator is placed in the enrollment record which may only be accessed by designated district personnel at the direction of the Homeless Liaison.

For the purposes of this regulation an eligible student is one who meets at least one of the following criteria:

• The family lacks a fixed, regular and adequate nighttime residence

• Shares the housing of other persons due to loss of housing, economic hardship, or similar reason(s)

• Lives in a motel, hotel, trailer park, or on camping grounds due to lack of other housing

• Lives in an emergency or transitional shelter

• Has a primary nighttime residence that is not a place for regular sleeping arrangements

• Lives in a car, park, public place abandoned building, or in substandard housing

If the student’s best interest supports enrollment in the school of origin, the district will ensure that transportation is provided, as follows:

• if the student continues to live in the area served by the district in which the school of origin is located, the district must provide or arrange for transportation to or from the school of origin.

• if the student continues his/her education in the school of origin but begins living in an area served by another district, the district of origin and the district in which the student is living must agree how to apportion responsibility and costs for providing transportation to and from the school of origin.

• if the districts can’t agree upon a method, responsibility and costs for transportation are shared equally.

All questions concerning student eligibility will be referred to the District Homeless Liaison.

La Ley de Asistencia a Personas sin Hogar McKinney-Vento garantiza los derechos educativos y las protecciones para niños y jóvenes que están experimentando la falta de vivienda. La intención del Distrito Escolar Público de Kiefer es brindar a todos los estudiantes elegibles bajo esta disposición la misma oportunidad de acceder a los servicios educativos. Se siguen estrictos procedimientos de confidencialidad, que incluyen una designación de acceso restringido en el Sistema de Información Estudiantil. Este indicador se coloca en el registro de inscripción y solo puede ser accesado por el personal designado del distrito bajo la dirección del Enlace para Personas sin Hogar.

A los efectos de este reglamento, un estudiante elegible es aquel que cumple al menos uno de los siguientes criterios:

• A la familia le falta una vivienda nocturna fija, regular y adecuada
• Comparte la vivienda con otras personas debido a la pérdida de su hogar, dificultades económicas u otra(s) razón(es) similar(es)
• Vive en un motel, hotel, parque de casas rodantes o en un camping debido a la falta de otra vivienda
• Vive en un refugio de emergencia o temporal
• Tiene una residencia principal nocturna que no es un lugar para dormir de manera regular
• Vive en un coche, parque, lugar público, edificio abandonado o en una vivienda en mal estado

Si lo que más le conviene al estudiante es permanecer en la escuela de origen, el distrito se asegurará de que se proporcione transporte, de la siguiente manera:

• Si el estudiante sigue viviendo en el área atendida por el distrito en el que se encuentra la escuela de origen, el distrito debe proporcionar o arreglar el transporte hacia o desde la escuela de origen.
• Si el estudiante continúa su educación en la escuela de origen pero comienza a vivir en un área atendida por otro distrito, el distrito de origen y el distrito donde el estudiante está viviendo deben ponerse de acuerdo sobre cómo repartir la responsabilidad y los costos para proporcionar transporte hacia y desde la escuela de origen.
• si los distritos no pueden ponerse de acuerdo sobre un método, la responsabilidad y los costos del transporte se comparten por igual.

Todas las preguntas sobre la elegibilidad de los estudiantes se remitirán al Enlace de Personas Sin Hogar del Distrito.
